Rule 38 – Exemptions

Any vessel, or class of vessels, whose keel was laid or which was at a corresponding stage of construction before the entry into force of these Regulations, provided she complies with the 1960 Collision Regulations, is exempted from full compliance for the periods set out below:

  1. (a)installation of lights with the ranges of Rule 22 — until 4 years after entry into force.
  2. (b)installation of lights with the colour specifications of Annex I — until 4 years after entry into force.
  3. (c)repositioning of lights resulting from the change from imperial to metric units and rounding — permanent exemption.
  4. (d)repositioning of masthead lights resulting from the Annex I horizontal-separation rules — on vessels of less than 150 metres, permanent exemption; on vessels of 150 metres or more, until 9 years after entry into force.
  5. (e)repositioning of masthead lights resulting from the Annex I height rules — until 9 years after entry into force.
  6. (f)repositioning of sidelights and sternlights resulting from Annex I — until 9 years after entry into force.
  7. (g)sound-signal appliance specifications of Annex III — until 9 years after entry into force.
  8. (h)repositioning of all-round lights resulting from Annex I — permanent exemption.
